Se inaplicó el Art. 1º del Decreto 1382 de 12 de julio de 2000, por ser contrario a la Constitución Política, en relación con la tutela promovida por el ciudadano de la referencia.
Así mismo, se dirimió la colisión de competencias suscitada entre el Tribunal Administrativo de Cundinamarca y el Juzgado 11 Civil Municipal de Bogotá, en el sentido de determinar que la competencia para tramitar la tutela le corresponde al mencionado Tribunal.

- PRIMERO. INAPLICAR, en relación con la acción de tutela promovida por el ciudadano Francisco Luis Peña Gutiérrez, el artículo 1º del Decreto 1382 de 12 de julio de 2000, por ser contrario a la Constitución Política conforme a lo expuesto en la parte motiva de este auto.
- SEGUNDO. DIRIMIR la colisión de competencias suscitada entre el Tribunal Administrativo de Cundinamarca, y el Juzgado Once Civil Municipal de Bogotá, en el sentido de determinar que la competencia para tramitar la tutela instaurada por Octavio Castro Sánchez le corresponde al Tribunal Administrativo de Cundinamarca, Sección Segunda, Subsección D.
- TERCERO. REMITIR el expediente de tutela al Tribunal Administrativo de Cundinamarca, Sección Segunda, Subsección D, para que adelante la correspondiente actuación judicial.
